Agreement to Terms

1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of the website splashhomeremodeling.inetpowered.com (the “Site”) operated by Splash Home Remodeling (“Splash Home Remodeling,” “we,” “us,” or “our”), a home remodeling contractor based in Richardson, Texas.

By accessing, browsing, or using this Site, you (“you,” “user,” or “visitor”) agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please do not use this Site.

These Terms govern your use of our website only. Any remodeling project we perform for you is governed by a separate, signed written contract between Splash Home Remodeling and the client. Nothing on this Site constitutes a binding offer to perform construction services.

2. About Splash Home Remodeling

Splash Home Remodeling is a residential remodeling company serving Richardson, Texas and surrounding Dallas–Fort Worth Metroplex communities. Our services include, but are not limited to:

    • Kitchen remodeling

    • Bathroom remodeling

    • Whole-home renovations

    • Room additions

    • Interior and exterior remodeling

    • Related design and construction services

Service availability, scope, pricing, and timelines are determined on a project-by-project basis and confirmed only through a written, signed agreement.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use this Site or request services from us. By using this Site, you represent that you meet these requirements.

4. Use of the Website

You agree to use this Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use of the Site. Prohibited conduct includes, but is not limited to:

    • Using the Site in any way that violates applicable federal, state, or local law or regulation;

A binding agreement is formed only when a written contract is signed by both you and an authorized representative of Splash Home Remodeling. That contract — not this Site or any informal communications — governs the terms of your remodeling project, including scope, price, payment schedule, change orders, warranty, and dispute resolution.

10. Communications

By submitting your phone number, email address, or other contact information through this Site, you consent to receive communications from Splash Home Remodeling regarding your inquiry, project, or related services. This may include calls, text messages (SMS), and emails. Message and data rates may apply. You may opt out of marketing communications at any time by replying STOP to text messages, clicking the unsubscribe link in marketing emails, or contacting us directly. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SPLASH HOME REMODELING DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that the Site will be uninterrupted, secure, free of viruses or other harmful components, or that defects will be corrected. Your use of the Site is at your sole risk.

This Section 13 applies to the Site only. Workmanship warranties applicable to actual remodeling work performed by Splash Home Remodeling are set forth in the written contract for that project.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SPLASH HOME REMODELING, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THIS SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall our total liability arising out of or related to your use of the Site exceed one hundred U.S. dollars ($100.00). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless Splash Home Remodeling, its owners, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your violation of any applicable law.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of those courts.

18. Dispute Resolution

Before initiating any legal action related to your use of this Site, you agree to first contact us in writing and attempt to resolve the dispute informally for at least thirty (30) days. If the dispute is not resolved within that period, either party may proceed in accordance with Section 17.

This Section 18 applies to disputes about Site use only. Disputes arising from a signed remodeling contract are governed by the dispute resolution provisions in that contract.

19. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

20. Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision. No waiver of any term shall be deemed a further or continuing waiver of that term or any other term.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Splash Home Remodeling regarding your use of the Site and supersede any prior agreements or understandings between us relating to Site use. They do not supersede or replace any signed written contract for remodeling services, which governs that work independently.

22. Changes to These Terms

We may update or modify these Terms at any time at our sole discretion. Updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
